Session Policies

At DARYL MCNAIR Photography, we feel it is important to meet the needs of the entire photographic experience. To help you make your total experience as fun and enjoyable as possible for all involved, please review the following Studio Policies as well as our Portrait Planning Guide.

Session Appointments:

  • All Appointments/Sessions are made on a first-come, first-served basis. No date or time will be held without a retainer.
  • Cameras, cell phone cameras, camcorders and other recording devices are not permitted in any Session.

Session Fees:

  • Your Session Fee includes your Photographer’s time and talent, their personal style of photography, minor retouching as well as a phone consultation to help plan your Session. It also includes the editing of your images and a slideshow presentation. Call or email for pricing.
  • Session Fees are to be paid at time of booking.
  • Session Fees can be paid by Cash, Check, Credit Card (via Square) or PayPal
  • Session fees are non-refundable

Session Agreement:

  • Before your scheduled Session Date, you will be given (via email) a Session Agreement form to sign. We cannot photograph anyone who does not sign the Session Agreement form or acknowledge said release via email no later than 48 hours prior to Session.
  • If Release is not signed and returned, nor acknowledged and accepted via email prior to 48 hours of the Session, DARYL MCNAIR Photography has the right to cancel the Session.

Returned Payment:

  • We understand that at times, payments may be returned for a variety of reasons. This is understandable; however DARYL MCNAIR can not be expected to fulfill delivery without payment in full. With this in mind…
  • Returned Payments are expected to be paid in full prior to imagery/product/services delivery
  • Returned Payments are subject to a $35.00 Returned Payment Fee
  • Returned Checks may not be paid for by check
  • Returned Payments, if paid via Payment Service (Venmo, Square, etc…) will be subject to a 5% Service Fee

In-Person ShowCase Ordering Appointment:

  • After your Photo Session, we will schedule your In-Person ShowCase Ordering Appointment, This Appointment will be set for no more than 14 days after your Photo Session. If additional time is needed for the ShowCase Session, DARYL MCNAIR Photography will notify the Client via email.
  • Orders are to be placed at the time of the SOA. It is very important that all decision makers be present. Should a 2nd Ordering Appointment be needed, there will be a $50.00 Rescheduling Fee.
  • We kindly request that you arrange for a babysitter for small children during the time of this appointment.
  • Images are not shared outside of the Studio until order arrives.
  • Except for purposes of “Sneak Peeks”
  • Upon order completion, Digital Images are delivered with the ordered image and are cropped at 4”x6” size as a S107 standard. Other cropped sizes are available at a cost of $ 25 per image.
  • 50% of payment is due before the order will be processed if you do not pay in full. DARYL MCNAIR Photography does NOT have a payment plan option at this time.
  • S107 offers a 5% Pay-in-Full Incentive should you wish to pay fully at time of order. 
  • Please note: Our Studio policy requires that your complete order be placed before we start processing any part of your order. 
  • Should you wish to make a change in your order, you have 24 hours after your order has been received to do so. You can add onto your order at any time.
  • Non-ordered images will be held for an additional 60 days after your Session date. After 60 days, all non-ordered images will be discarded. All ordered images will be archived for 1 year from Session date for your safe keeping.
  • S107 has a variety of PORTRAIT COLLECTIONS Offerings ranging from $ 595.00 to 
  • $ 2,495.00. (prices subject to change without notice)
  • ALL COLLECTION OFFERINGS COME WITH LOW-RES IMAGES (of ordered images) FOR FACEBOOK, EMAIL, SCREEN SAVERS AND SHARING ON CELL PHONES, & IPADS!
  • We also have the opportunity for you to create your own customized order with our A LA CARTE COLLECTION (S107 minimum order of $ 295.00)
  • High resolution images of purchased Images may be purchased with usage rights from our DIGITAL COLLECTIONS (starting at $ 95.00). (S107 still own all copyrights)

“Gifted Sessions” (Voucher, Contest or Otherwise Complimentary)

  • “Gifted Sessions” are those Sessions which for whatever reason, (Voucher Redemption, Contest Winner, Gifted from third party, etc…) has the Session Fee ($295), and / or Hair & Makeup Fee waived.  
  • Although “Gifted Sessions” are truly gifted, a Retainer Fee is still required to hold the Scheduled Date and Time. The Retainer Fee for Gifted Sessions is $95 and will be used towards the purchase of products or future photographic services.
  • For all Session types, should the Client be more than 15 minutes late, DARYL MCNAIR has the right to reschedule the Session to another agreed upon date and time, not to exceed 2 weeks from original Session Date. In the event of a Client being more than 15 minutes late to the rescheduled Session, The Studio has the right to cancel said Session and not reschedule. Retainer Fee will be forfeited to make up for Photographer’s prep time on each Session.
  • Should the Studio decide to reschedule for a third time, Client will then book a full Session and pay full Session and Hair & Makeup Fees.

Schedule Arrangements: 

  • Due to the nature of the Session Appointments, (some Sessions are booked back to back), a strict timeline will be enforced to ensure Session Scheduled obligations are met. In the event of a client being greater than 15 minutes late, DARYL MCNAIR will reschedule the Session for another agreed upon date and time, not to exceed 2 weeks from original Session Date. In the event of a client being greater than 15 minutes late a second time, client will forfeit their rights to the agreed upon Session. 

Cancellations:

  • S107 understands that circumstances and emergencies beyond your control can and do happen, making it necessary to cancel a scheduled Session. In that event and if possible, we would appreciate 24-hour’s notice. In ANY event, please call the Studio to discuss your particular situation.
  • If you do not call and are a no-show, any Session deposit/retainer paid will be forfeited. Any rescheduled Session/Appointment due to a no-call/no-show will have a $50 reschedule fee.
  • If you would like to reschedule within 48 hours from the time of your cancellation, you can apply the initial Session Fee to the rescheduled Session. If a Session is not rescheduled during this time frame, you forfeit the Session Fee.
  • Likewise, S107 reserves the right to reschedule a Session due to illness, injury, family emergency, extreme weather conditions, and other extenuating circumstances. The Studio truly values your time and will do our utmost to notify you of such circumstances if they should arise as soon as possible. We will be sure to reschedule your Session for the next available date.
  • After your Photo Session, we will schedule your In-Person ShowCase Ordering Appointment, for you to come in to the Studio and see your photographs. We have a variety of awesome products and ways for you to enjoy and share your images! We are here to help you through this process.

Model Release:

  • ALL clients of DARYL MCNAIR Photography MUST sign a model release. This allows us to show our work to others like you who are looking for a “Personal Photographer.”
  • S107 reserves the right to use any image captured for promotional, advertising, display, publication, web, or any like purpose. Unless otherwise noted in the contract or agreement, permission is granted to use images and/or reproductions for promotional, advertising, display, publication, web or any like purpose. All files remain the exclusive intellectual property of Daryl McNair Photography.
  • The client hereby grants permission to Studio/Photographer to sell images to any other interested family members or parties unless instructed otherwise. Such instructions must be specific, in writing, and conveyed when the images are captured at the Session Appointment.
  • Before your scheduled Session Date, you will be given (via email) a model release form to sign. We cannot photograph anyone who does not sign the model release form or acknowledge said release via email prior to Session.
  • If Release is not signed and returned, nor acknowledged and accepted via email prior to 24 hours of the Session, DARYL MCNAIR Photography has the right to cancel the Session.

Additional Information

Children Sessions:

  • Keeping in mind that we’re dealing with young children, Children Sessions are kept between 30 to 40 minutes in duration. To get the most out of your Session, it is best to have a Consultation with your Photographer prior to your Session date.
  • If your child is ill, please call to reschedule your Session. It is very important for the safety and health of future families that the Studio remain as germ free as possible. Besides – most children will not show off their true personality if they are not feeling well. There will not be a rescheduling fee for this type of rescheduling.
  • S107 allows one Children Session rescheduling per client.
  • No shows will forfeit Session Fee.

Retouching:

  • Basic retouching is included in the initial Session Fee.  
  • This may include, red eye reduction, moderate blemish removal, basic color correction and polishing of your images. Additional retouch requests are available for an additional “advanced retouching” fee of $25 per image.

Image Use and Copyright: 

  • S107 owns and maintains the copyright of all images taken. S107 reserves the right to use photographs from any session for promotional purposes, display, advertising or print competition. (Personal information will not be used in conjunction with the images unless otherwise specified in the model release.)    

  • Printed images may not be copied, scanned, reproduced or otherwise published without proper release from the Photographer. A limited print release is granted to purchaser of digital images.     
  • SC Sales Tax is applicable on all orders.
  • Please allow 4 – 6 weeks for your order to be processed.
  • Due to the personalized nature of this business, all product orders are non-refundable once full or partial payment is received.
  • Prices are subject to change without notice.

Digital Files (digital negatives):

  • S107 does not sell any high resolution digital files unless a minimum order of $250.00 has been placed. Reproduction of any photograph without the written consent of DARYL MCNAIR Photography is violation of federal copyright law.
  • After fulfilling the $250.00 minimum order, Digital Files are sold at $95/Image.  
  • Digital Images of purchased Images are provided with your purchase.
